Terms of Service Agreement

Welcome to NUDGE BY DIGITVL (also known as NUDGE), a service that allows users to create landing pages to collect emails and phone numbers from their fans. By using our service, you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

1. Email and Phone Number Collection: By opting in to receive notifications from any of the people you subscribed to, you are also subscribing to be contacted by NUDGE BY DIGITVL regarding updates to our service, terms of agreement, and other marketing materials, unless you opt out.

2. Prohibited Activities: The use of our services for pornographic content, soliciting illegal services, cryptocurrency and other non-compliant activity when it comes to mass messaging is strictly prohibited and will lead to the termination of your account.

3. Compliance with Laws and Regulations: You agree to use our services in compliance with all applicable laws and regulations, including without limitation, the CAN-SPAM Act, TCPA and GDPR.

4. Intellectual Property: NUDGE BY DIGITVL and its licensors own all rights, title and interest in and to the service, including all intellectual property rights. You shall not use, reproduce, distribute or display any portion of the service without the prior written consent of NUDGE BY DIGITVL.

5. Changes to Terms of Service: NUDGE BY DIGITVL reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.

6. Termination: NUDGE BY DIGITVL, in its sole discretion, has the right to terminate or suspend your account and refuse any and all current or future use of the service, or any other NUDGE BY DIGITVL service, for any reason at any time.

7. Disclaimer of Warranties: The service is provided on an “as is” and “as available” basis. NUDGE BY DIGITVL and its licensors make no representations or warranties of any kind, express or implied, as to the operation of the service or the information, content, materials, or products included on the service.

8. Limitation of Liability: In no event shall NUDGE BY DIGITVL or its licensors be liable for any damages whatsoever, including but not limited to, direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use the service.

9. Governing Law: These Terms of Service and any dispute arising out of or in connection with this agreement shall be governed by and construed in accordance with the laws of UNITED STATES, without giving effect to any choice of law or conflict of law provisions.
